Welcome to Aka Meowniverse. These Terms of Service govern your access to and use of our website, online store, products, services, custom-order services, and related features.

Throughout these Terms, “Aka Miniverse,” “we,” “us,” and “our” refer to Aka Miniverse, doing business as Aka Minicerse. “You” and “your” refer to any visitor, customer, purchaser, account holder, or other person using our website or services.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer products and services to you.

By visiting our website, placing an order, submitting a customization request, creating an account, or otherwise using our services, you agree to these Terms of Service and to the policies referenced in them. Please read these Terms carefully before using our website.

If you do not agree to these Terms, please do not use the website or purchase our products or services.

1. Eligibility

You must be at least the age of majority in your state, province, or country of residence to make a purchase from our store.

A minor may use the website or make a purchase only with the involvement and permission of a parent or legal guardian. The parent or legal guardian is responsible for the minor’s use of the website and compliance with these Terms.

By placing an order, you represent that the information you provide is accurate and that you are legally authorized to use the selected payment method.

2. Store Policies

The following policies are incorporated into these Terms by reference:

  • Shipping Policy

  • Privacy Policy

  • Custom Order or Commission Policy, when applicable

If a product listing contains terms that are more specific than these general Terms, the product-specific terms will apply to that product to the extent of any conflict.

Nothing in these Terms limits any rights that cannot legally be waived under applicable consumer-protection law.

3. Products and Services

We offer products that may include:

  • Handmade artisan keycaps

  • Made-to-order products

  • Fully customized commissions

  • Original-design merchandise

  • Authorized guest-artist merchandise

  • Manufactured metal keycaps, pins, magnets, stickers, and accessories

  • 3D-printed products and accessories

  • Acrylic products

  • Keycap pullers, switches, fidgets, display accessories, and related merchandise

  • Other products or services described on our website

Product availability, designs, materials, colors, finishes, pricing, and specifications may change without notice.

We may discontinue a product, limit quantities, impose purchase limits, or restrict sales to particular customers, households, geographic locations, or jurisdictions when reasonably necessary.

4. Handmade and 3D-Printed Characteristics

Many Aka Miniverse products are handmade, hand-painted, cast, finished, assembled, or 3D printed in small batches.

Because of the nature of handmade production, products may contain reasonable variations, including minor differences in:

  • Color

  • Paint placement

  • Sculpting details

  • Texture

  • Finish or gloss level

  • Dimensions

  • Positioning

  • Small mold or casting marks

  • Small bubbles that do not affect normal use

  • 3D-print layer lines

  • Surface appearance

  • Packaging presentation

These normal handmade or small-batch variations help make each item unique and are not considered defects when they do not materially affect the product’s appearance, function, durability, or safety.

Products described as manufactured, factory-produced, or produced by a guest artist’s manufacturing partner may have greater consistency but may still contain reasonable manufacturing tolerances.

5. Product Images, Colors, and Measurements

We make reasonable efforts to display product images, colors, finishes, dimensions, and descriptions accurately.

However:

  • Screen settings may affect how colors appear.

  • Photographs may be enlarged to show detail.

  • Lighting may change the apparent color or finish.

  • Measurements may contain small reasonable tolerances.

  • Packaging may change without notice.

  • Handmade products may not be identical to the sample photographed.

Props, keyboards, switches, keycap pullers, display stands, packaging, and other accessories shown in photographs are not included unless the product listing expressly states that they are included.

Please review the complete product description before purchasing.

6. Keyboard Compatibility and Customer Responsibility

Customers are responsible for checking product compatibility before ordering.

Unless otherwise stated, artisan keycaps are intended for the switch stems, layouts, mounting systems, and key positions identified in the relevant listing. Compatibility may vary based on the keyboard, switch orientation, case design, neighboring keycaps, stabilizers, profile, and key placement.

A keycap fitting one switch type does not guarantee that it will fit every keyboard using that switch type without interference.

Please contact us before ordering if you are uncertain about compatibility. Compatibility problems caused by an incorrect customer selection are handled according to our Return and Refund Policy.

7. Product Care and Intended Use

Customers must use and care for products in accordance with the product description, care instructions, packaging warnings, and any instructions provided with the order.

Depending on the product, improper care may include:

  • Dropping, crushing, bending, or pulling delicate components

  • Removing a keycap by pulling on the sculpted figure instead of using an appropriate keycap puller

  • Forcing a product onto an incompatible switch or device

  • Exposing products to excessive heat, flame, sunlight, moisture, solvents, alcohol, acetone, harsh cleaning chemicals, or abrasive materials

  • Submerging products in water

  • Using excessive force

  • Allowing children or pets to handle small or fragile items without appropriate supervision

  • Using decorative displays as functional keyboards when the listing identifies them as display products

Damage caused after delivery by misuse, accident, improper installation, incompatible equipment, unauthorized alteration, ordinary wear, failure to follow care instructions, or improper storage is not considered a manufacturing defect.

8. Safety and Small Parts

Many products contain small parts and may present a choking hazard.

Unless a product listing expressly states otherwise:

  • Products are intended for adult collectors and users.

  • Products are not toys.

  • Products are not intended for children under three years of age.

  • Products should be kept away from babies, young children, and pets.

  • Products must not be placed in the mouth or consumed.

  • Packaging materials should be kept away from children and pets.

Magnets can be dangerous if swallowed and may interfere with certain medical devices or electronics. Keep magnetic products securely away from children, pets, implanted medical devices, magnetic storage media, and sensitive electronics. Customers with implanted medical devices should follow the device manufacturer’s guidance regarding magnets.

Our products are not designed or certified for medical, protective, emergency, food-contact, or life-safety applications unless expressly stated otherwise.

9. Orders and Order Acceptance

Submitting an order is an offer to purchase the selected products under these Terms.

An automated order-confirmation email confirms that we received your order. It does not necessarily mean that we have finally accepted or agreed to fulfill the order.

We may accept, reject, limit, or cancel an order for legitimate reasons, including:

  • Product unavailability

  • Incorrect pricing or product information

  • Suspected fraud or unauthorized payment

  • An invalid or undeliverable address

  • Violation of purchase limits

  • Suspected unauthorized resale

  • Technical or payment-processing errors

  • A customization request we cannot reasonably complete

  • A request involving prohibited or potentially infringing content

  • Conduct that violates these Terms

If we cancel a paid order before fulfillment, we will issue the appropriate refund to the original payment method, except where we are legally permitted to retain an expressly disclosed, earned, or nonrefundable fee.

We may contact you to verify order, payment, customization, or shipping information before accepting or fulfilling an order.

10. Prices, Payment, and Taxes

Prices are displayed in the currency identified at checkout and may change without notice.

The price charged for an order will generally be the price displayed when the order is submitted, subject to correction of obvious errors and our right to reject or cancel the order as described in these Terms.

You agree to provide current, complete, and accurate billing, shipping, contact, and payment information.

Applicable sales tax, shipping charges, and other charges will be displayed or calculated at checkout when required.

International customers are responsible for customs duties, import taxes, brokerage charges, carrier fees, and other destination-country charges unless the checkout or product listing expressly states otherwise. These charges are not controlled by Aka Meowniverse.

Payment processing may be provided by Shopify Payments, Shop Pay, PayPal, credit-card networks, or other third-party providers. Your use of those services may also be subject to the provider’s terms and privacy practices.

11. Pricing and Listing Errors

We make reasonable efforts to keep pricing, availability, product descriptions, discount information, and other website content accurate.

Occasionally, information may contain a typographical, photographic, pricing, inventory, technical, or descriptive error.

We may correct an error and, where legally permitted:

  • Reject or cancel an affected order;

  • Contact you for instructions;

  • Offer fulfillment at the correct price; or

  • Issue a refund.

We will not increase the price of an accepted order without your informed agreement.

12. Discounts, Gifts, and Promotional Offers

Discounts, free gifts, promotional products, and special offers:

  • Are subject to availability;

  • May have eligibility requirements;

  • May not be combined unless expressly stated;

  • May be limited to one per customer, household, order, or promotion;

  • May exclude taxes, shipping, custom commissions, limited editions, or guest-artist products;

  • May be changed or discontinued when legally permitted.

A free gift has no cash value and generally cannot be returned or exchanged separately from the qualifying purchase unless it arrives materially damaged or defective.

If a qualifying purchase is returned and the return causes the order to fall below the promotional threshold, we may require the unused promotional item to be returned or deduct its disclosed value from the refund where permitted by law and clearly disclosed in the promotion.

13. Custom and Personalized Orders

Custom and personalized products may be subject to additional terms stated in the product listing, quotation, invoice, Custom Order Policy, or written project agreement.

Before production, we may require:

  • Reference images

  • Measurements

  • Color selections

  • Written specifications

  • Approval of a concept or design

  • Full payment or an agreed deposit

  • Confirmation that the submitted materials may lawfully be used

Estimated completion dates are estimates unless we expressly agree in writing to a guaranteed deadline.

Once design or production work begins:

  • Cancellation rights may be limited as described in the applicable policy;

  • Design, consultation, or production fees may become nonrefundable to the extent earned and permitted by law;

  • Material changes may require an additional charge;

  • Changes may extend the production timeline;

  • Approved design elements generally cannot be changed without additional cost.

You are responsible for carefully reviewing names, spelling, colors, measurements, selected options, references, and design approvals before production.

We are not responsible for an error that accurately reproduces information or an approval provided by the customer, except to the extent otherwise required by law.

14. Customer-Supplied Content and Reference Materials

When you provide photographs, artwork, logos, character references, written content, measurements, names, or other materials for a custom order, you represent that:

  • You own the materials or have permission to use them;

  • Our requested use of the materials will not infringe another person’s copyright, trademark, privacy, publicity, contractual, or other rights;

  • The materials are accurate and lawful;

  • The requested product is not intended for unlawful commercial reproduction or resale.

You grant us a limited, nonexclusive license to use the supplied materials only as reasonably necessary to evaluate, design, produce, document, communicate about, and fulfill your order.

We will not use identifiable customer photographs or private custom references in public marketing or portfolio materials without permission, except where the material has already been publicly submitted for promotional participation or another lawful basis applies.

We may reject or cancel a request that we reasonably believe is unlawful, dangerous, abusive, hateful, deceptive, infringing, or outside our technical or artistic capabilities.

15. Intellectual Property

The website and its content—including product designs, sculptures, artwork, photographs, graphics, videos, logos, text, product names, packaging designs, digital models, molds, characters, branding, and layout—are owned by Aka Meowniverse, licensed to Aka Meowniverse, or used with permission.

Guest-artist artwork, designs, names, and related intellectual property remain the property of the applicable artist or rights holder and are used under authorization, license, or other permission.

Purchasing a physical product does not transfer any copyright, trademark, design right, manufacturing right, commercial-use right, digital file, mold, or other intellectual-property right.

Without prior written permission, you may not:

  • Reproduce or manufacture our products;

  • Create molds or casts from our products;

  • Scan, trace, copy, or extract our designs for commercial use;

  • Create or distribute unauthorized digital models;

  • Use our artwork or product photography to sell another product;

  • Remove or alter ownership, artist-credit, or copyright notices;

  • Represent yourself as an authorized seller or collaborator;

  • Use our trademarks or branding in a misleading manner;

  • Mass-produce, sublicense, or commercially exploit our designs.

You may photograph a lawfully purchased product for personal, noncommercial use, collection displays, reviews, and ordinary social-media sharing, provided that you do not falsely imply sponsorship or ownership of the underlying design.

16. Guest-Artist Products

Some products are designed, produced, manufactured, or authorized by independent guest artists.

The relevant listing may identify:

  • The guest artist;

  • Whether the product is handmade or manufactured;

  • The manufacturer or production method, when appropriate;

  • Product-specific materials or care requirements.

The guest artist is not necessarily the seller of record. Unless otherwise stated, purchases made through our store are processed and supported by Aka Meowniverse under the policies displayed on our website.

Artist credits do not grant customers permission to reproduce, manufacture, distribute, or commercially use the artist’s work.

17. Preorders and Made-to-Order Products

Preorder and made-to-order listings will include an estimated processing or release period.

These estimates may be affected by:

  • Handmade production time

  • Material availability

  • Manufacturing schedules

  • Artist delivery schedules

  • Quality-control issues

  • Carrier delays

  • Customs processing

  • Events beyond reasonable control

If a material delay occurs, we will provide notice and any cancellation or refund option required by applicable law.

Combining preorder and ready-to-ship products in one order may cause the entire order to ship together when the preorder item is ready, unless the listing or checkout states otherwise.

18. Shipping and Delivery

Processing times and carrier transit times are separate.

A processing estimate describes the time needed to prepare, make, inspect, and package an order before carrier acceptance. Carrier transit estimates begin after the shipment is accepted by the carrier.

Delivery dates are estimates unless expressly identified as guaranteed.

Customers are responsible for providing a complete and accurate shipping address. Please contact us immediately if an address correction is needed. We cannot guarantee that an address can be changed after fulfillment begins.

Shipping, delay, lost-package, stolen-package, returned-package, customs, and address-correction matters are governed by our Shipping Policy.

Nothing in this section limits any obligation we have under applicable law concerning delayed or undelivered merchandise.

19. Returns, Replacements, and Refunds

Returns, replacements, cancellations, and refunds are governed by our Return and Refund Policy.

Different rules may apply to:

  • Fully customized items

  • Personalized products

  • Made-to-order handmade products

  • Non-custom handmade products

  • Manufactured guest-artist merchandise

  • Clearance or final-sale products

  • Products damaged through customer misuse

  • Items that arrive damaged, defective, or incorrect

A product’s designation as handmade, customized, or final sale does not eliminate any non-waivable rights applicable to products that arrive materially damaged, defective, incorrect, or not as described.

Please inspect your order promptly after delivery and contact us within the period stated in our Return and Refund Policy if there is a problem.

20. Reviews, Comments, and Public Submissions

You may submit product reviews, comments, photographs, or other content where our website provides that feature.

You retain ownership of your original content. By voluntarily submitting content to a public review or community feature, you grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, display, format, and share that content for operating and promoting our store, subject to applicable law and our Privacy Policy.

You represent that your submission:

  • Is truthful and based on your genuine experience;

  • Does not infringe another person’s rights;

  • Does not contain confidential personal information;

  • Is not unlawful, threatening, harassing, hateful, obscene, deceptive, defamatory, or malicious;

  • Does not contain malware, spam, undisclosed advertising, or fraudulent content.

We may moderate or remove content when reasonably necessary, but we do not guarantee that all user-submitted content will be reviewed.

Nothing in these Terms prohibits an honest review or a legally protected report to a government agency.

21. Prohibited Uses

You may not use the website or our services:

  • For an unlawful or fraudulent purpose;

  • To violate intellectual-property rights;

  • To submit false payment, identity, shipping, or account information;

  • To interfere with website security or operation;

  • To distribute malware, scraping tools, or harmful code;

  • To harvest customer or visitor information;

  • To impersonate another person or business;

  • To conduct unauthorized automated purchasing;

  • To circumvent purchase limits;

  • To engage in abusive, threatening, discriminatory, or harassing conduct;

  • To place orders for unauthorized reproduction or counterfeiting;

  • To resell products in a manner that falsely suggests authorization, partnership, or affiliation;

  • To make fraudulent payment disputes or knowingly false claims.

We may restrict access, cancel orders, or terminate accounts for material violations of these Terms, subject to applicable law.

22. Third-Party Services and Links

Our website may use or link to services operated by Shopify, payment processors, shipping carriers, social-media platforms, review platforms, analytics providers, or other third parties.

Third-party services are governed by their own terms and privacy practices. We are not responsible for the independent acts, omissions, content, availability, security, or policies of third parties, except to the extent responsibility cannot legally be excluded.

A link to a third-party website does not necessarily mean that we endorse all content, products, or services available there.

23. Giveaways, Contests, and Promotions

Giveaways, contests, sweepstakes, scratch-card promotions, and similar events may be governed by separate Official Rules.

The Official Rules may address eligibility, geographic limitations, age requirements, entry methods, promotion dates, prize descriptions, winner selection, notification, taxes, disqualification, and platform disclaimers.

If these Terms conflict with promotion-specific Official Rules, the Official Rules control for that promotion.

Unless expressly stated, promotions are not sponsored, endorsed, administered by, or associated with Shopify, YouTube, TikTok, X, Instagram, Meta, or any other social-media platform.

24. Convention and In-Person Sales

When displayed or otherwise provided at the time of purchase, these Terms and our applicable sales policies may also apply to purchases made at conventions, markets, exhibitions, pop-up events, and other in-person venues.

Certain operational terms may differ for in-person sales, including:

  • Immediate inspection of the product;

  • Available payment methods;

  • Event-only pricing;

  • Event-exclusive products;

  • Promotional gifts;

  • Receipt procedures;

  • Return methods.

Any event-specific terms displayed at the booth or on the receipt supplement these Terms.

25. Disclaimer of Warranties

We make reasonable efforts to provide accurate information and products that conform to their descriptions.

Except for express warranties stated in a product listing and warranties that cannot legally be excluded, the website, products, and services are provided on an “as available” basis.

To the fullest extent permitted by applicable law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

This disclaimer does not limit any warranty, remedy, or consumer right that cannot legally be waived.

26. Limitation of Liability

To the fullest extent permitted by applicable law, Aka Meowniverse and its owners, employees, contractors, licensors, guest artists, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or products, including lost profits, lost data, lost opportunity, or business interruption.

To the fullest extent permitted by law, our aggregate liability arising from a particular order will not exceed the amount paid to Aka Meowniverse for the product or service giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, gross negligence where applicable, or other non-waivable obligations.

Some jurisdictions do not permit certain warranty disclaimers or liability limitations. In those jurisdictions, the limitations apply only to the maximum extent permitted by law.

27. Indemnification

To the extent permitted by law, you agree to indemnify and hold Aka Meowniverse harmless from third-party claims, damages, losses, and reasonable costs arising from:

  • Your material violation of these Terms;

  • Your unlawful misuse of the website or products;

  • Content or reference materials you submit;

  • Your infringement of another person’s intellectual-property, privacy, publicity, or other rights;

  • Fraudulent or intentionally misleading information provided by you.

This section does not require a consumer to indemnify us for our own negligence, unlawful conduct, or breach of these Terms.

28. Payment Disputes

Please contact us promptly if you believe a charge is incorrect or if there is a problem with an order. We ask that you give us a reasonable opportunity to investigate and resolve the matter.

Nothing in these Terms waives or restricts any chargeback, billing-error, credit-card, or payment-dispute right that cannot legally be waived.

Knowingly making a false claim that an authorized purchase was unauthorized, that a delivered order was not received, or that an item was materially different from its description may constitute fraud and may result in account restrictions or other lawful action.

29. Force Majeure

We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, natural disasters, fire, flood, epidemic, labor disruption, war, civil unrest, government action, customs delays, carrier interruption, internet or utility outage, supplier failure, manufacturing disruption, or material shortages.

This section does not eliminate any legally required right to cancel or receive a refund for merchandise that cannot be shipped within the required period.

30. Changes to the Website, Products, and Terms

We may update the website, products, services, policies, or these Terms from time to time.

The current version will be posted on this page with an updated “Last updated” date.

Changes will apply prospectively from their effective date unless applicable law permits or requires otherwise. Material changes will not retroactively alter an already accepted order without the customer’s agreement, except where necessary to comply with law or address fraud or security risks.

Your continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms.

31. Suspension and Termination

We may suspend or terminate access to the website or an account when reasonably necessary because of:

  • A material violation of these Terms;

  • Fraud or security concerns;

  • Abusive conduct;

  • Unlawful activity;

  • Repeated unauthorized payment disputes;

  • Attempts to interfere with the website or another customer.

Termination does not eliminate payment obligations or rights that arose before termination.

Sections that by their nature should survive termination—including intellectual-property, liability, dispute, and indemnification provisions—will remain effective.

32. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted or modified as necessary, and the remaining provisions will remain in effect.

33. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

A waiver is effective only if made in writing by an authorized representative of Aka Meowniverse.

34. Entire Agreement

These Terms, together with the policies, product listings, custom-order agreements, invoices, promotion rules, and other terms incorporated by reference, constitute the agreement between you and Aka Meowniverse concerning your use of the website and purchase of our products or services.

35. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Subject to any rights that cannot legally be waived, disputes arising from these Terms or a purchase from Aka Meowniverse will be brought in the state or federal courts having jurisdiction over [County], New York.

Nothing in this section prevents either party from bringing an eligible claim in small-claims court.

If you are a consumer residing in a jurisdiction whose mandatory consumer laws provide additional rights or require disputes to be heard elsewhere, those mandatory protections remain applicable.

Before filing a formal claim, we encourage you to contact us so that we can attempt to resolve the matter informally.
